Health Commissioner Asks for AG’s Office Help on Medical Marijuana Legal Challenges

Oklahoma Attorney General Mike Hunter Monday accepted Oklahoma Department of Health Interim Commissioner Tom Bates request to review the legal challenges to the agency’s medical marijuana rules put into place by the Board of Health last week. Because of two last minute amendments narrowly adopted by the Board, two pro-medical marijuana groups are suing.

During the meeting last week, the legal counsel for the Department of Health advised the Board not to adopt the proposed amendments because she did not believe it had the legal authority to do so.

Bates sent the AG a letter asking for a legal review and “how best to proceed with the defense of this action.”

“We will expedite this request in order to give clarity to the Department of Health on how to address this legal challenge,” Hunter said. “The review will be thoughtful, thorough and transparent. We will publicly release the findings and recommendations provided to Mr. Bates when completed, hopefully by the end of the week.”
