Senate Judiciary Committee Advances Bill To Tighten Foreign Land Ownership Law

The Oklahoma Senate Judiciary Committee has approved Senate Bill 1582, a proposal by Oklahoma Senator Brian Guthrie aimed at closing what he describes as loopholes in the state’s ban on foreign land ownership.

“We cannot allow unclear language to undermine the intent of Oklahoma law,” Guthrie said. “This legislation finally shuts down those loopholes and guarantees our lands are purchased only by lawful citizens.”

Guthrie said earlier versions of the law included phrases such as “shall become” and “who may become a bona fide resident,” language he argues created enforcement gaps.

Senate Bill 1582 defines a bona fide resident as a lawful permanent resident of the United States. The bill further defines a lawful permanent resident as a foreign national granted the right to reside permanently in the United States.

The measure also requires that if a resident alien ceases to qualify as a bona fide resident of Oklahoma, they must dispose of the land within one year.

SB 1582 is now eligible for consideration by the full Senate.
