U.S. Supreme Court Hears Oklahoma Plea to Limit McGirt

The U.S. Supreme Court heard oral arguments and discussed the Oklahoma v. Castro-Huerta case on Wednesday. Since the Supreme Court’s McGirt decision in 2020, criminal jurisdiction has shifted from the state prosecuting crimes with tribal reservations. Using the Castro-Huerta case, Oklahoma is seeking to prosecute non-Natives who commit crimes on the reservations, regardless of the victim.

Reuters’ Lawrence Hurley writes the Court appeared divided as it considered the impact of its decision on the case. A decision is expected to be released by the end of June.
