OK Supreme Court Backs State in McGirt Related Decision Concerning Domestic Violence Protections

The Oklahoma Supreme Court rendered a “narrow” decision this week which allows the state of Oklahoma to issue victim protection orders for Native citizens within reservation territory. It further defines civil law in the wake of the McGirt decision, which reshaped criminal jurisdiction in Eastern Oklahoma.

The Oklahoman’s Chris Casteel writes the decision stems from a case in McIntosh County district court when a member of the Muscogee Nation sought the protective order against a member of the Cherokee Nation going to state court instead of the tribal court.

The man accused of abusing the victim and threatening to burn down her home used the McGirt decision to try to have the victim protection order dismissed.
