Hern Proposes Legislation to Prevent Child Support Administration Issues

The IRS is getting ready to change one of its rules that will impact how states maintain their child support programs. Congressmen Kevin Hern is introducing legislation that would prevent that impact and give additional resources to tribal nations.

The Strengthening State and Tribal Child Support Enforcement Act would grant tribal child support programs access to the same tax information that state child support agencies currently have. It also allows states and tribes to share that information with contractors who are administering the child support program.

Hern says if the IRS rules were to go into place it could impact nearly 13 million families in the federal Child Support Enforcement (CSE) program. That is about 18 percent of all children in the U.S.

“Tribal families in Oklahoma and around the nation deserve the same assistance to recover unpaid child support payments as provided by non-tribal agencies,” said Hern. “Congress should be in the business of strengthening families to ensure our children have a supportive environment to grow. I’m proud to introduce this bipartisan bill with my colleagues!”

The new IRS rule limiting the use of contractors is set to be effective on October 1, 2024.
