Oklahoma Attorney General Gentner Drummond filed briefs asking the U.S. Supreme Court to deny St. Isidore of Seville Catholic Virtual Charter (SISVC) School and the Statewide Charter School Board’s request to take their case under consideration in becoming the nation’s first state-sponsored religious public school.
The School and the Board asked the U.S. Supreme Court in October to take the case after the Oklahoma Supreme Court ruled that the contract violated both the Oklahoma and U.S. Constitutions.
Drummond argues that the Supreme Court should deny certiorari for four main reasons; St. Isidore’s proposal violates two provisions of the Oklahoma Constitution apart from any possible U.S. Constitution violations, there is no split among circuit courts concerning this type of case, the facts of St. Isidore’s situation make it a “poor vehicle” for the U.S. Supreme Court to address constitutional considerations, and the Oklahoma Supreme Court got the decision correct.
