The Biden Administration has filed a brief in the U.S. Supreme Court challenge to the Renewable Fuel Standard exemption process by the operators of the Wynnewood refinery.
OK Energy Today reports the U.S. 10th Circuit Court of Appeals recently decided against the challenge saying that exemptions should only be given to refineries which have received waivers every year since the Renewable Fuel Standard program began and refineries which have not, should not be allowed to apply.
The Biden Administration brief sides with the 10th Circuit Court ruling.
The Supreme Court is set to hear the case next month.
