Drummond’s Request for Injunction Against Title IX Rule Change Successful

Oklahoma Attorney General Gentner Drummond’s request for an injunction against new Biden Administration gender identity rules under Title IX was granted by an Oklahoma City federal judge on Wednesday.

Drummond filed a lawsuit in May to stop the rule from going into place. He contends that the U.S. Department of Education’s new rule concerning transgender students exceeds its authority.

U.S. District Judge Jodi Dishman granted the preliminary injunction as the case begins to unfold in the U.S. District Court for the Western District of Oklahoma.

“The Final Rule elevates gender identity and its accompanying protections above that of biological sex. Such a contradiction of Title IX’s text and an erosion of its purpose cannot be permitted absent congressional action,” Dishman wrote in her ruling.

Drummond praises the decision.

“This well-reasoned ruling helps to protect both female and male students from invasions of privacy and unnecessary harm,” Drummond said. “Our students deserve the protections that have long been provided by Title IX.”

While the new rules were set to go into effect on August 1, 2024, this injunction will prevent it from being enforced in Oklahoma. Other federal judges have issued injunctions against the regulation, as well.
