Oklahoma Rep. Tom Gann has received more time to ask the U.S. Supreme Court to review an Oklahoma utility case involving $250 million in rate increases and $700 million in winter storm bonds for Public Service Company of Oklahoma.
Justice Neil Gorsuch granted the deadline extension. The Supreme Court has not agreed to hear the case. Gann’s request for review is due Nov. 25.
Gann argues the Oklahoma Supreme Court failed to address his claims that utility customers’ constitutional rights were violated.
The case is part of a broader effort by Gann and fellow Republican Reps. Kevin West and Rick West to challenge utility costs approved by the Oklahoma Corporation Commission. According to the lawmakers, they have brought 14 appeals involving PSO, Oklahoma Natural Gas and Oklahoma Gas and Electric.
Their concerns include whether customers received adequate notice and a fair opportunity to participate in cases affecting their bills.
The lawmakers are also asking the Oklahoma Supreme Court to reconsider its dismissal of two ONG appeals.
In a separate PSO case, Gann and other customers are challenging a decision that prevented them from participating as formal parties. They want stronger protections for existing customers as regulators consider rates for large electricity users, such as data centers.
