A Choctaw couple has filed a federal lawsuit using the U.S. Supreme Court’s McGirt decision to claim that they do not owe the state of Oklahoma taxes.
Tulsa World’s Curtis Killman writes the couple lives with the Choctaw Reservation and gets their income from the Choctaw Nation. Their lawsuit contends that a previous 1973 U.S. Supreme Court decision provides that tribal members living on a reservation with income derived from reservation resources are not subject to state income tax.
Up until now, the McGirt decision has only been applied to criminal jurisdiction.
